1. Description: J.B. Hunt Transport, Inc.’s carrier appreciation drawing (the “Drawing”) is designed to thank motor carriers for the contributions they make to the transportation industry. No purchase of any product or service is necessary and purchases do not in any way increase the chance of winning in the Drawing.
2. Sponsor: The Drawing is sponsored by J.B. Hunt Transport, Inc. (“J.B. Hunt”), a Georgia corporation with its principal address at 615 J.B. Hunt Corporate Drive, Lowell, AR 72745, USA, 1-844-252-1764.
3. Binding Agreement: To participate in the Drawing, you must agree to these Official Rules and Terms of Use and any additional rules or criteria that are disclosed in any future email communication you may receive (hereinafter collectively referred to as the “Official Rules”). You will not be eligible for the prize described in the Official Rules unless you agree to the Official Rules. You agree that participating in this Drawing constitutes your agreement to the Official Rules.
4. Eligibility: The Drawing is open to all J.B. Hunt-approved motor carriers with a J.B. Hunt 360°® administrative profile that have serviced at least one load for J.B. Hunt between January 1, 2023 and August 01, 2023, and that do not opt out of the Drawing before 11:59 PM Central Time on September 4 (“Giveaway Opt-Out Deadline”). Such motor carriers are referred to herein as “Registrants.” Registrants must be domiciled in any of the 50 states of the United States or the District of Columbia. By participating in the Drawing, Registrants are confirming that they are domiciled in one of the 50 states of the United States or the District of Columbia. Current employees of J.B. Hunt are not eligible to participate in the Drawing.
Selection of Winners: Three “Winners” will be selected from eligible entries in a random drawing conducted by J.B. Hunt at its corporate office in Lowell, Arkansas on or about September 5, 2023 (the “Drawing Date”). J.B. Hunt will notify each Winner by phone or email, using the phone number or email address associated with each respective Winner’s first-created J.B. Hunt 360 administrative profile, within four (4) business days of the Drawing Date. J.B. Hunt assumes no responsibility for missed or late entries, or entries containing incorrect or incomplete information, due to technical error or other causes outside of J.B. Hunt’s control. Winners will have 4 days from the date they are notified of their win to confirm contact information and a mailing address for prize redemption. Winners will be publicly announced via email by September 15, 2023. By participating in the Drawing, you agree that if you are selected as a Winner, you will not disclose your win to any third party, except to your legal or tax advisor or otherwise as required by law or regulation, until J.B. Hunt has publicly announced the Winners.
5. How to Participate:
All qualifying motor carriers will be entered into the drawing. If you do not wish to participate in the drawing, you may contact the J.B. Hunt Perks Team at (833) 701-3886 before the Giveaway Opt-Out Deadline and ask to opt out of participation.
Limit one entry per person. Only Registrants who comply with the Official Rules and who meet the eligibility requirements described herein will be eligible for the Drawing and to receive a prize.
6. Prizes: Three prize packages (“Prizes”) will be awarded. One Winner will receive two XtremeXperience Platinum Package Certificates donated by The Goodyear Tire & Rubber Company (“Goodyear”), with an approximate value of $2,500; a SiriusXM factory (aptiv) radio for truck or plug and play radio with 12 months free Platinum SiriusXM subscription, approximate value of $300; a Pilot Flying J $300 gift card, die-cast truck, tumbler, mug and coffee coupons , approximate value of $380; 12 months free roadside service subscription provided by Roadside Masters, approximate value of $360; a Dorman Diesel Decoder from Russ Darrow, approximate value of $300; and J.B. Hunt swag, approximate value of $320. Total approximate prize value of $4,160. A second Winner will receive a SiriusXM plug-and-play radio with 12 months free Platinum SiriusXM subscription, approximate value of $300; a Pilot Flying J $200 gift card, die-cast truck, tumbler, and coffee coupons, approximate value of $280; 12 months free roadside service subscription provided by Roadside Masters, approximate value of $360; a Dorman Diesel Decoder from Russ Darrow, approximate value of $300; and J.B. Hunt swag, approximate value of $320. Total approximate prize value of $1,560. The third Winner will receive a SiriusXM plug-and-play radio with 12 months free Platinum SiriusXM subscription, approximate value of $300; a Pilot Flying J $150 gift card, tumbler, and coffee coupons, approximate value of $180; 12 months free roadside service subscription provided by Roadside Masters, approximate value of $360; a Dorman Diesel Decoder from Russ Darrow, approximate value of $300; and J.B. Hunt swag, approximate value of $320. Total approximate prize value of $1,460. The odds of winning a Prize depends on the number of eligible Registrants. Prizes are subject to availability, capacity, age and other restrictions, and consist of only the items specifically listed herein. Each Winner is solely responsible for all other expenses not specifically set forth herein, including but not limited to transportation, travel and other costs and expenses not otherwise mentioned herein. No alcohol is awarded in the Prizes. J.B. Hunt is not responsible for service delays, cancellations or any policies that prohibit or delay Winners from claiming the Prizes. Each Winner agrees to accept his or her Prize “as-is” and Registrants hereby acknowledge that Sponsor makes no warranty, representation, or guarantee relative to any Prize. Prizes provided exclusively by a prize supplier may be subject to additional terms and conditions as determined by the prize supplier. In the event a donor revokes a service or item, or a Winner is otherwise unable to redeem such service or item, J.B. Hunt will have no obligation to award compensation in lieu thereof. J.B. Hunt is not responsible for lost, mutilated or stolen items. No substitution of Prizes for cash or other goods or services is permitted. The Prizes will be shipped to the respective Winners within 14 days of the date that the respective Winner confirms his or her contact information and mailing address. Prizes are not transferable. Winners are solely responsible for any and all federal, state, or local taxes related in any way to the Prizes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable Prizes. Winners may be subject to income tax withholding. Actual retail value of the Prizes may vary due to market conditions.
7. Conduct: By participating in the Drawing, you agree to comply with and be bound by the Official Rules and all applicable federal, state, and local laws. Failure to comply with the Official Rules or applicable law may result in disqualification from the Drawing. J.B. Hunt reserves the right, in its sole discretion, to disqualify any Registrant who: (a) tampers or attempts to tamper with the entry process or the operation of the Drawing; (b) violates the Official Rules; or (c) acts in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten, or harass any other person. Any false information provided in connection with the Drawing by any Registrant concerning identity, postal address, ownership of right, or compliance with the Official Rules may result in the immediate disqualification of the Registrant from the Drawing. J.B. Hunt further reserves the right to disqualify any entry that it believes, in its sole and unfettered discretion, violates any law or does not comply with the Official Rules.
8. Media Activity: By participating in the Drawing, each Winner grants J.B. Hunt permission to use his or her name, city, state/province, e-mail address, photograph, likeness, voice and/or entry for advertising, promotion, publicity or other purposes without additional consent or compensation, except where prohibited by law.
9. Privacy Notice: By participating in the Drawing, you agree that J.B. Hunt may collect your personal information, and that if it cannot collect the required data, you may not be eligible to participate in the Drawing. Any personal information collected during the course of the Drawing by J.B. Hunt will only be used for administering the Drawing, access to J.B Hunt 360, and for other purposes as described in the Official Rules, and will be subject to the practices described in J.B. Hunt’s Privacy Policy (located at https://www.jbhunt.com/privacy/).
10. General Conditions: The Drawing is subject to all applicable laws and is void where prohibited by law. By participating in the Drawing, Registrants agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, Registrant’s rights and obligations, or the rights and obligations of J.B. Hunt in connection with the Drawing, are governed by, and construed in accordance with, the laws of State of Arkansas, without giving effect to any choice of law or conflict of law rules. Any and all claims, judgments and awards will be limited to actual out-of-pocket losses sustained, including costs associated with participating in the Drawing, but in no event will attorney’s fees or punitive damages be recoverable.
By participating in the Drawing, you agree to be bound by the terms of the Official Rules and by J.B. Hunt’s decisions, which are final and binding on all matters pertaining to the Drawing. Return or refused delivery of any Prize or Prize notification may result in disqualification and selection of an alternate Winner. Any potential Winner who cannot be contacted within 14 days of attempted first notification will forfeit his or her Prize. Potential Winners may be required to sign, notarize, and return an Affidavit or Declaration of Eligibility, a Liability/Publicity Release, an I.R.S. Form W-9, and agree to provide any additional information that may be required by J.B. Hunt. Failure to comply with these requirements within the time period specified may result in disqualification and selection of an alternate Winner. J.B. Hunt is not responsible for any typographical or other errors in the offer, administration of the Drawing, or in the announcement of the Prizes. Each Registrant agrees not to participate in the Drawing in any manner that might (a) infringe upon any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (b) otherwise violate applicable law in any countries in the world.
By participating in the Drawing, participants agree: (a) to be bound by the Official Rules and the decisions of J.B. Hunt, which are final and binding, and (b) that J.B. Hunt, its parent, subsidiary and affiliated companies, their respective officers, directors, agents, and employees, are not responsible for and are not be liable for: (1) any incorrect or inaccurate information associated with the Drawing, whether caused by website users, tampering, hacking, or malfunction of any equipment or programming errors associated with or utilized in the Drawing; (2) any errors, omissions, interruptions, deletions, defects, delays in operation, or unauthorized access to the website or in any materials associated with the Drawing; (3) any injury, damage, or loss to participants’ or any other person’s computer related to or resulting from participating in the Drawing or downloading materials from, or otherwise using, the Website; (4) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (5) any design, typographical or other errors in any materials associated with the Drawing; (6) missed, late, or unprocessed entries; (7) any condition caused by events beyond the control of J.B. Hunt which may cause the Drawing to be disrupted or corrupted; or (8) any loss, injury or damage of any kind, whether bodily injury or property damage, caused by (in whole or in part) or arising from any person’s participation in the Drawing, or the acceptance, participation, and/or use or misuse of the Prizes.
11. Choice of Law: Any and all disputes, claims and causes of action arising out of or connected with the Drawing, or any Prize awarded, must be adjudicated individually, without resort to any form of class action, and exclusively in Benton County, Arkansas in accordance with the laws of the state of Arkansas. Registrants consent to the personal jurisdiction of and exclusive venue in the federal and state courts located in or for Benton County, Arkansas.
12. RELEASE, INDEMNIFICATON, AND LIMITATION OF LIABILITY: BY PARTICIPATING IN THE DRAWING, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE, DEFEND, HOLD HARMLESS, AND INDEMNIFY J.B. HUNT, ITS PARENT, SUBSIDIARIES AND AFFILIATED COMPANIES, THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, EMPLOYEES AND ASSIGNS, FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RELATED TO OR RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH BY YOU OF ANY WARRANTY SET FORTH HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE, DEFEND, HOLD HARMLESS, AND INDEMNIFY J.B. HUNT, ITS PARENT, SUBSIDIARIES AND AFFILIATED COMPANIES, THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, EMPLOYEES AND ASSIGNS, FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES FOR OR IN RESPECT OF WHICH J.B. HUNT WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THE OFFICIAL RULES, INCLUDING WITHOUT LIMITATION THOSE RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION BY YOU, WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THE OFFICIAL RULES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE, DEFEND, HOLD HARMLESS, AND INDEMNIFY J.B. HUNT, ITS PARENT, SUBSIDIARIES AND AFFILIATED COMPANIES, THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, EMPLOYEES AND ASSIGNS, FOR ANY INJURY OR DAMAGE TO YOU CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATING IN THE DRAWING AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON. THE PRIZES ARE OFFERED AS IS AND J.B. HUNT IS NOT LIABLE FOR CLAIMS IN ANY WAY RELATED TO THE PRIZES INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR PROPERTY DAMAGE, PERSONAL INJURY, WARRANTY CLAIMS, AND UPGRADES. WINNERS ASSUME ALL LIABILITY FOR ANY INJURIES OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE DRAWING OR BY THE USE OR MISUSE OF ANY PRIZE.
13. Third Parties: J.B. Hunt is not responsible for the policies, actions, or inactions of others, including your employer, that might prevent or prohibit you from participating, and/or claiming a Prize in the Drawing and for any action taken against you by such third party.
15. Internet: J.B. Hunt is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. J.B. Hunt is not responsible for theft or destruction or unauthorized access to or alterations of Drawing materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. J.B. Hunt is not responsible for inaccurate transmissions of or failure to display Drawing materials on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the Drawing is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Drawing, J.B. Hunt reserves the right at its sole discretion to cancel, terminate, modify or suspend the Drawing.
16. Severability: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
17. Winner List: The names of the Winners will be publicly announced as described in Section 4 above and will be otherwise provided upon request.
BY PARTICIPATING IN THE DRAWING, YOU AGREE THAT YOU HAVE READ AND ACCEPTED ALL OF THE DRAWING OFFICIAL RULES AND TERMS OF USE.
